Civil liability insurance: an essential protection in daily life

Reading time 3 minutes

In Switzerland, civil liability insurance – often called liability insurance – is one of the essential protections to consider in private life. It covers the damage that you could unintentionally cause to another person or to their property. Although it is not systematically mandatory, it becomes unavoidable in many everyday situations, in particular when you rent a property, practise certain activities, or own a pet.

Understanding the role of civil liability insurance

Civil liability insurance protects you financially if you are held responsible for material, bodily or moral damage caused to others. This may concern, for example:

  • an object broken at a relative’s home,
  • a fall caused by your dog in the street,
  • water damage occurring in a neighbouring apartment.

It applies in a private context, outside your professional activity.

Good to know: there are also specific insurances to cover other contexts. For example, owner’s civil liability insurance is required in the context of construction or renovation projects.

Insurance often required, even if not mandatory

Swiss law does not systematically make liability insurance mandatory. However, it is frequently required:

  • when signing a rental lease;
  • for certain leisure activities or sports (for example hunting or skiing);
  • for dog owners in certain cantons.

It also constitutes an essential complement to other forms of insurance such as building insurance or fire insurance, particularly in the event of damage caused to third parties.

Special case in Geneva: in the canton of Geneva, liability insurance is imposed for any rental and must be combined with household insurance with glass breakage coverage. This requirement appears in the General Conditions and Rental Rules and Practices. A specific clause in leases stipulates that the tenant must have these insurances and undertakes to maintain them throughout the duration of the contract.

What does private civil liability insurance cover?

Here are the main types of damage covered by private civil liability insurance:

  • Bodily injury caused to another person (e.g.: injury during a sporting activity).
  • Material damage, such as the deterioration of a borrowed item.
  • Damage caused by your children or your pets.
  • Damage caused in a rented dwelling, such as an accidental fire or a water leak (to be completed by construction works insurance if renovations are in progress).

These guarantees may be extended depending on your contract. It is important to read the exclusions carefully.

What is the price of civil liability insurance in Switzerland?

The cost varies according to several parameters:

  • the level of deductible chosen;
  • the coverage ceiling (often expressed in millions of CHF);
  • the composition of your household (individual or family);
  • the specific risks covered (activities, animals, vehicles…).

On average, count between 100 and 250 CHF per year for complete coverage.

FAQ – Civil liability insurance

Is civil liability insurance mandatory in Switzerland?

No, but it is strongly recommended. In certain cases, it becomes practically essential (rental, risky activities, keeping animals…).

Am I covered if my child breaks something at a neighbour’s?

Yes, provided that your civil liability policy includes the coverage of your family. Most standard contracts cover minor children.

Does civil liability cover damage in a dwelling under renovation?

No, in this case, it is preferable to take out construction works insurance, in addition to your civil liability insurance.

Is there a link between civil liability and building insurance?

Yes. Building insurance protects the very structure of a property. Civil liability only intervenes if you cause damage to a third person or to their property.

What is the difference between private civil liability and owner’s civil liability?

Owner’s civil liability covers damage caused to third parties in the context of construction works. It is specific to real estate projects, unlike private civil liability, which concerns events of daily life.

Taking out civil liability insurance allows you to protect yourself against the financial consequences of an incident caused to others. Whether it is clumsiness, a domestic accident, or damage in the context of a rental, this protection often proves indispensable, notably in addition to other guarantees such as fire insurance or building insurance.

Before signing a contract, check the exclusions, the amounts covered, and do not hesitate to compare the offers to choose the one which corresponds the best to your way of life.
